My Company Charges for References, Is that Legal?

Dear Experts, My company just instituted a new policy. They are going to charge any company that calls to do a reference check on a former employee $13. Is that legal? It's like they are holding my employment history hostage. Will potential employers bother to pay or will they just decide not to bother with me?
